Summary: CJ and Toby negotiate the ramifications of an agreement they made years ago.

Agreements Revisited - part 1

Sometimes she wonders how she got to where she is today. As she looks around the crowded bar, she knows that tonight is one of those nights. She wondered why she had agreed to go out with Josh, Sam, and Toby, she knew she wasn't going to be good company that night. She looks towards the bar and watches Josh who had gone to get another round of drinks. She glances over at Toby when she hears him say her name.

"Yes?" She asked.

"Penny for your thoughts."

"If we were in Greece, would you say drachma for my thoughts?"


"That's probably about all they are worth anyway."

"So what are they?"

"My thoughts?"


"I believe I'm getting ready to throw myself a pity party?" She smiled slightly


"No particular reason." She shrugged.

"I know you. There must be a reason."

"What is next Thursday?"

"Ah..." He said after he thought for a moment. "I see."

"Yes, my birthday."


"I'll be 41."


"Just making sure you remember that." She smiled.



"How many years have I known you?"


"And how many times have I made a big deal out of your birthday?"

"Let me think about that for a minute....the answer would be zero."


"Then you can say, I'm making sure you don't make a big deal out of this one." She smiled. "People might think you like me or something?" She laughed.


"I'm kidding."

"Yeah." He sighed. "Why don't you come home with me?"


"Sam." CJ said as she got up.


"We're going. See you tomorrow."

"Okay, night."

CJ and Toby left just before Josh came back to the table with the drinks. "I thought there were two more people here when I left." He said to Sam.

"CJ and Toby left."

"Ah okay."

"They're going back to his place."

"They are?" Josh grinned.


"It's about time."


CJ sat on the couch while Toby made coffee. She almost jumped when she felt his hand on her shoulder.

"Sorry I didn't mean to startle you." Toby said.

"It's okay."

He sat down and handed her a cup of coffee. He was also holding a piece of paper in his hands.

"Thank you." She said softly. "What is that?"

He handed the paper to her, and waited for her to read it.

"I can't believe you still have this." She said after she read it.


"It's been fifteen years."

"I know."

"I thought this was nullified when you married Andi." CJ said quietly.

"I'm not married to Andi any longer."

"I know."


"You aren't serious?"


"It was fifteen years ago, hell we were drunk."

"I know that."

"Let me see if I have this straight..."


"You are saying that you'll marry me because fifteen years ago we agreed that if I wasn't married by my 41st birthday, you would marry me?"



"Are you saying that...."

"I'm saying you need to work on a better proposal. Then I'll answer."


She stood "I should go."

"You don't have to."

"Why not?" She laughed.

"Because Sam and Josh know you are here."

"They think we are sleeping together."

"No, they think we will be getting very little sleep tonight."

"You know what I meant!"


"Okay." She sat back down on the couch.

He pulled his laptop out as she laid down on the couch and went to sleep.
